There shall be a County Motorcycle Transport & Safety Board
· Anyone who wishes to operate a motorcycle for commercial purposes will be required to register with the respective County Executive Committee Members & pay the prescribed fee
· The County Executive Committee Member shall submit a register of licensed operators every 3 months to NTSA
· Every owner of a motorcycle shall ensure it is fitted with a tracking device, approved by the County Executive, that allows for real time identification of the location
· Anyone who owns a motorcycle for commercial purposes shall register with a Cooperative Society recognised under the Cooperative Societies Act
· Every owner of a motorcycle registered for commercial purposes shall not permit any person to ride their motorcycle unless they hold a valid driver’s/provisional license in respect of that class of motorcycles & a valid written employment contract
· Every owner shall issue a rider with 2 helmets that comply with KEBS standards & are of the prescribed colour & 2 reflective jackets of the prescribed colour
· Every rider of a 2-wheeled motorcycle shall ensure a load exceeding 50kgs & an adult passenger are not carried at the same time
· Every passenger of a 2-wheeled motorcycle shall ensure they properly wear a helmet & reflective jacket whenever being carried
· A child who is less than 13 years old may be carried together with an adult passenger provided they are seated between the rider & the passenger
· Anyone who rides a motorcycle on a pavement or pedestrian walkway or in any other area not designated shall be liable to a fine not exceeding Kes 20,000 or a jail term not exceeding 6 months or both
· Any rider who participates in ganging up with other riders to intimidate, threaten or harm another person shall be liable to a fine not exceeding Kes 100,000 or a jail term not exceeding one year or both
